Service and AGB´s

1. Applicability

These Terms and Conditions apply to all shipments that Soul Wool sends to consumers according to (§ 13 BGB).

Attention: Payments that are not pre-payments, can only be paid by transfer onto the stated Paypal Account. Please double check your invoices which you have received directly from Paypal.

3. Quotation and Conclusion of Contract

3.1 The presentation of our products in the online shop does not represent a binding offer, but the call for submitting a quotation. Errors and omissions excepted

3.2 By clicking "Buy now" in the last step of our ordering process, you submit a binding order, which represents a an offer to us until the contract is concluded. When you order products from us, we send you an email which confirms the receipt of your order and lists all order details (order confirmation). This order confirmation does not represent a legal acceptance of your offer, but only is to inform you that we have received your order. A legally binding purchasing contract is only concluded when we ship the ordered product to you and confirm the shipment with a second email to you (shipping confirmation). Products that are not listed on this shipping confirmation have not been legally bought by the buyer.

4. Right of Withdrawal for Consumers

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (Soul Wool c/o Kremke Handelsgesellschaft mbH, Am Kanal 4, 19372 Garwitz, info@soul-wool.com, Phone: +49 (0)38722 227 25) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Return shipments only for skeins, hanks and packs in the original state.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

5. Prices and Shipping Costs

5.1 The prices stated on the product pages are stated including German VAT as well as other components of the price.

6. Shipping

6.1 Shipping will be executed by Fedex/TNT, DHL or DPD.

6.2 Shipping time within Germany is appr. 1-3 days. Should an item be sold out, we notify you about the expected worst case shipping time on the respective product page. Should we expect delayed shipping, we will notify the consumer immediately.

6.3 We ship only complete orders. Should individual items in one order not be in stock, the shipment of the whole order is delayed respectively. Part-shipments are only possible after previous agreement. Extra shipping costs may occur. Please check with our customer service.

7. Payment

7.1 Payment is possible by Paypal-Invoice (is possible even if you don't have a Paypal account), by Paypal or credit card. When you chose "payment by paypal invoice" payment date is 14 days from the date of the invoice.

8. Property Retention

The goods remain our property until full payment.

9. Warranty

The legal warranty applies. For all defects that appear with the legal warranty period of 2 years, you have the right of supplementary performance. You can chose between elimination of the defect or replacement and – if the legal preconditions are met – you have the right to mitigation or to withdraw from the contract as well as the right to compensation.
